A $25 million federal lawsuit award and two startling cases of restaurant discrimination…1355 Words

North or South, patrons confronting discriminatory service in a food establishment is an ordinary event …but not always.
Floyd Mori wrote about a valuable Atlanta Hawks NBA basketball player who was denied service in an upscale Atlanta restaurant because of his casual designer attire.
The refusal shocked the celebrity athlete because he had never experienced refusal at any restaurant prior and dined in high-end establishments. And he saw other patrons at the restaurant in casual clothing.
Mr. Mori’s article and two recent news stories below inspired this content.
Several months ago, a federal jury in New Jersey awarded a White regional manager more than $25 million as a result of the Starbucks incident involving two men of color, in their early 20s back in 2018.
For those unfamiliar with the backstory
The two men were seated quietly at a table when police approached and arrested them for the first time in their lives at a Philadelphia Starbucks.
One of the arrested men with the stunned look in news videos had been a customer at the location since age 15. (NPR)
Double lock handcuffed, hands behind their back, according to phone videos with millions of views seen worldwide. Fellow customers were outraged and demanded to know what the men had done wrong.
Police took the men to jail.
Minutes before police were called one of the men had asked to use the restroom, but the woman behind the counter refused. Her request that a purchase be made for a beverage or some such was politely declined.
The men were waiting for a third man to arrive for a months-long business real estate deal.
Meanwhile, the woman behind the counter called the police, in the speed-of-light range from the time the men entered the shop, according to GMA.
Starbucks generously declined to press charges. Fraternity brothers protested outside the shop. It was a complete PR nightmare.
There was hope back then the incident might lead to lasting change.
Judge for yourself.
Corporate changed the policy of allowing noncustomers to use their bathrooms. And mandatory racial sensitivity workshops for all employees were ordered closing all the Starbucks shops for a day.
Harvard and other experts have documented forced racial sensitivity training does not work.
The next step by Starbucks was to engage in costly misplaced blame and fire a regional manager who was not responsible for what had happened to the men, according to a federal jury trial.
But how much would it have cost instead to skip the race sensitivity workshops, place the blame squarely on the person who made the call, and institute workshops outlining an immediate zero-tolerance or forfeit job policy?
Does an open bathroom policy address the problem of biased or racist employees targeting patrons?
Why does it take a race-based workshop to instruct employees not to call the police on an innocent patron regardless of the race, color, or creed of the person?
Keisha Lance Bottoms, the former mayor of Atlanta, and senior presidential advisor in the Obama administration entered a mall national brand steakhouse in 2022 and was denied a requested seat in the main dining room or the bar area because she was wearing leggings.
Curiously, as the former mayor departed, a White patron entered wearing leggings but did not come back out, according to Keisha Lance Bottoms.
After posting about her experience, White readers wanting to help the former mayor posted their photos of the inside of the steakhouse showing people in all manner of casual garb, even medical scrubs.
Learned something new…
It’s no secret restaurants and related businesses have a long history of denying customers of color entry into their establishments based on clothing guidelines.
But European patrons are allowed to enter attired in the same garb that disqualifies people of color from entry.
In the case of the national brand steakhouse, the guideline wording was written to allow color-biased discretion.
Imagine how much business some food establishments would lose if they refused to allow White patrons attired in casual garb inside or even at a table outside the main area.
Until I read Mr. Mori’s post about the NBA athlete and clothing guidelines, I realized I had never looked at the wording of some of the so-called guidelines.
As Mr. Mori commented… “There are ways for people to be racist and to make it appear that it is not racism.”
Police called for slowing-moving restaurant patrons
Last weekend, a group of five successful professionals including two married couples…with reservations a month ahead at an Orlando, Florida restaurant for jazz entertainment… paid their $600 bill.
Yet while the group was still seated the manager called the police to escort the group out of the restaurant. (Roland Martin)
Date stamps corroborate the group had been there for 60–90 minutes. There was no policy of vacating tables after a set time as some restaurants inform patrons verbally and in writing, according to Martin.
The police arriving on the scene were very good. It has been suggested the trainer of those officers should tour nationally to teach other officers. I agree.
But this incident has a major twist, the five guests later learned the owner’s son, the manager, not only called the police but lied to the other patrons stating the group of five could not pay their $600 bill, so the police had to be called to escort them out.
Fabricating a lie to explain racist behavior was the perfect strategy…sort of…if the bill had not been paid would that not mean an arrest versus being merely escorted out of the restaurant?
The manager could not very well admit another family of color too was asked to leave, at the same time while celebrating their father’s birthday.
Unfortunately for the management, a patron left a Google review noting what happened and wrote in part of being unsure whether the party of five did not pay their bill.
Managerial arrogance, stupidity, and misconduct…breathtaking.
What exactly will the police call tapes reveal the manager told them?
Details of the ordeal were expertly captured on a cellphone with a panoramic view of the dining area, including patron demographics and the agitated manager on his cell phone trying desperately to avoid being filmed.
According to Martin and his guest host, the details are senseless.
Not so if you consider the reservations were made well in advance online via a third-party platform.
Not until the five entered the establishment did the manager realize people of color were on his property…and that may be okay if they work for him but…
The five patrons targeted controlled their emotions perfectly and two questions come to mind.
  1. Minus legal fees and pain-related expenses, will the family-owned restaurant remain in the family?
  2. Will there ever be a state or a federal law passed with stiff fines prohibiting the use of police calls as a weapon?
Thank you for reading.

Cool Church Choir’s Unexpected Guest

Choir groups do not usually scream like concert fans while singing, but such was the case back in the summer of 2010.

A Texas based church choir, Voice of Praise, visited New Orleans and presented a secular program to sidewalk spectators. Out of nowhere, it seemed, a Grammy-Award winning multi-genre singer, songwriter, actor, and entrepreneur walked by on the sidewalk and began to watch and clap to their beat.

You see, he had heard the music from his terrace nearby. The beat was familiar…one of his hits.

His appearance was not planned nor did the church group even know the musician was in the state, said stunned choir officials later… meanwhile the unexpected visitor was asked to jam on the drums…

And the sidewalk crowd grew and grew.

Humor is underscored by an onlooker behind the choir, high above on the street watching below. When the onlooker realizes who is singing, she claps a hand on both sides of her head.

For the choir, an unforgettable memory.  For the spectator far behind and above the choir…Why, oh why am I up here?

Popular Toy Invented By 12-Year-Old CEO Started At Age 5

Watch an episode of Shark Tank and see what happens when presenters cannot answer questions about the figures involved in operating their business.

During a recent airing of the Tamron Hall show Mia Monzidelis admitted math was not her strong suit. But she must know the key figures involved with her Power Pony invention, such as how much her product will cost, landed from overseas, and how much to charge wholesale so that retailers can mark it up for resale.

Note the figures cited below are guesstimates.

In the toy industry the average profit is 23-25 percent based on what?  Mia knows the answer.

Consider the surprise that Mia gave to the delighted audience… beats a T-shirt!  If there are 250- to 350 audience members, says TV Tickets, and each receives a value of $200 that is a sizable figure.

But how many more products will sell because of that free offering?

Cost of Bad Business Services Highlighted on Antiques Roadshow

The recent airing of Antiques Roadshow (AR) underscores how important it is to evaluate a business or professional service provider… in all fields.

Not everyone despite their educational background or business presence may be as knowledgeable and render service…well.

The theme of the AR episode showcased how visitors burst into tears upon hearing the appraisal value of the item they brought. In the example below, I’m certain if the person who originally sold the family heirloom, a Tiffany lamp, watched the episode, she would have wept more.

The original owner took her heirloom to two different appraisers and based on their opinions decided to sell it for $125 back in the late 1960s.

A costly mistake is an understatement.

Trust sometimes cancels out due diligence even when due diligence is taken.  In the example below, the credentials and experience of the appraisers could not have been top-drawer. Consulting Tiffany might have been helpful and a membership association of certified appraisers.

While costly for consumers, even more damaging when a self-employed consumer consults a business or service provider or manufacturer who turns out to be subpar.

Pavarotti’s Diverse and Amazing Fan Base: From Babies to Hip Hop

Luciano Pavarotti, a former elementary school teacher, became an internationally known opera singer. You don’t have to like opera to appreciate Pavarotti’s fabulous talent. And his venture later into popular music was niche genius.

Considered the best in opera history, the sound of Pavarotti’s voice could hold the attention of a baby.

Three memorable clips featuring listeners introduced to the iconic singer appear below. For instance, the coach and teacher team, The Rob Squad, and the brothers Twins the New Trend. For most of the listeners, hip hop had been their genre of choice until they fulfilled their subscriber’s requests. But in the case of delightful baby ears (and feet), parental guidance was involved.

Famous City Uses Funny Bedtime Horror Story As A Sales Tool

A clever ad campaign by the Las Vegas Convention and Visitors Authority resonates with many viewers. It started seven months ago.  The ad based on a cookbook, is directed at parents and explains how to escape to their city for alone time.

But one does not have to be a parent with small children or teens to appreciate the humor. Countless adults have memories of veggies they absolutely detested while growing up.  So, imagine learning the place you planned to visit with your parents is all about that vegetable; never have the words “with stems” been more horrifying.

See video below.

Update
The ad is now running frequently on major TV networks, presumably for upcoming Father’s Day.

A Funny Family Lesson About Alone Time

A video from the Tameron Hall show earlier this year must rank as a top contender for a chuckling out loud moment.

The video first posted two years ago, went viral with more than 10 million views. It’s a revealing look at understanding one’s personality likes and dislikes at an early age.  Vital information many others never learn while growing up.

Based on the mom’s description of her son’s carving out alone time, he may grow up to prefer an independent or solo work career path as opposed to one in which activities or engagement with a large group would be required.

Black History Month and Social Studies: A Different Path

As February comes to an end, an article written last year by Joel A Johnson’s One-Track Mind Storytelling comes to mind. He stressed the need to look for uplifting stories rather than repeating the narratives about often-heard heroes, and depressing subject matter; year after year…after year.

60 Minutes aired a story segment recently about a middle school social studies teacher who uses an approach like the suggestion in Johnson’s article.

Three students were interviewed and confirmed that from kindergarten to the sixth grade they learned about the same historic people over and over including, entrepreneur Madam C. J. Walker.

The students’ present social studies teacher includes in her curriculum a vast, diverse digital library titled The HistoryMakers: Documenting untold stories of African American achievement. Established in 1999 and archived in the Library of Congress it catalogs the oral stories of notable African Americans. For instance, Barak Obama, a Tuskegee Airman, famous sports figures, entrepreneurs, writers, musicians, academics, and countless others.

Students are introduced to Black history achievements they never knew about. And the students pick and study people who overcame adversity and succeeded.

Cheers!

The Nicholas Brothers Danced like Superheroes to Jumpin Jive

If superheroes danced, they might use the moves performed by the late Fayard and Harold Nicholas in the 1940s film Stormy Weather. Today, some believe Computer Generated Imagery may be the only way to duplicate their filmed dance sequences.

Many people including, Fred Astaire, Mikhail Baryshnikov, and Gregory Hines were fans. According to Fred Astaire, the dance sequence in Stormy Weather was the finest film sequence he had ever seen.

The Nicholas Brothers were honored by the Kennedy Center in 1991 for their body of work spanning six decades.

Back Story

What is also so incredible about the dance sequence in Stormy Weather is that it all started with a little boy, Fayard Nicholas, watching famous Black entertainers perform in theatres, imitating their performances and teaching himself then his siblings how to dance.

The color movie clip below featuring Fayard, and his younger brother Harold, seven years his junior, showcases two performers who had no formal training: no film rehearsal, one take.

Starting in infancy, baby Fayard accompanied his parents, college educated musicians to their theatre jobs where he learned a lot about show business in his early youth (youth-ling?). The black and white video clip below underscores his childhood progress and that of his pupil, his younger brother Harold.

Exposing a toddler to a creative environment had jaw dropping results in this case. Both brothers were talented. But Fayard Nicholas in addition to the natural ability of a dancer, exhibited creative ability and teaching skill in the genius range.

In the film, Cab Calloway is the host and singer, crooning “Jumpin Jive” with his orchestra. Calloway, the first African American musician to sell one million records introduces the Nicholas brothers and then humorously bops out of the scene.

2 Teachers React to 70s Hit Song with an Odd Title

Husband and wife coach and teachers, Jay and Amber Robinson of the Rob Squad YouTube channel responded to a suggestion from their diverse subscriber base to react to a video by KC and the Sunshine Band from the 1970s.

So, early one morning they listened to a song they had never heard before; music, 2.5 of them did not expect to hear given the odd sounding song title.

Fun memorable video.

Back Story

Rarely does one see a musical group with a lead White singer, front man Harry Casey, in which, except for Casey’s producer also a band member, all the other members are African American.

KC and the Sunshine band (KC&SB) formed in the mid-1970s in Florida, 11 miles from Miami Beach, would in time become internationally known. And the band’s music crossed color lines, past and present as the second video below underscores.

Without video, many people today regardless of color, believe Harry Casey, aka KC, was an African American singer.

For instance, check out the husband-and-wife team, Shawn and Mel as they watch the suggested video “That’s the Way I like It”, then their astonishment as it slowly dawns on them, they can’t initially pick out which musician in the mixed group is KC.

Harry Casey and the Sunshine Band are credited with practicing diversity long before it was a buzzword.
